1.             INFINITE ENERGY DEFINED: For the purposes of these Official Rules, Infinite Energy shall mean Infinite Energy Holdings, Inc. and all parent, subsidiary, and affiliated companies thereto.

 

2.             NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

 

3.             ENTRY INTO DRAWING:  Each Infinite Energy account (“Account”) in good standing and a member of the CFG service pool will automatically receive one entry into the Free Gas Giveaway, unless an authorized person for such Account (the “Account Holder”) requests to be removed from the drawing (see Section titled “Miscellaneous”).

 

4.             ELIGIBILITY:  In order to be entered into the drawing, the Account must be (a) receiving services from Infinite Energy, (b) in good standing, and (c) a member of the CFG service pool.  Employees of Infinite Energy (and the immediate family members of all such employees, and all others with whom they reside) are not eligible to participate or win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.

 

5.             PRIZES:  Infinite Energy will draw, by or on July 1, 2011, two (2) winners to receive free gas with Infinite Energy for a year or 12 billing cycles, whichever is less, but in no event will the value of the winner’s prize exceed $1,000.00 in total.  The prize will appear as a credit on the Account’s invoice each month.

 

6.             DRAWING:  Winners will be selected by random drawing conducted by Infinite Energy from all qualified entries.  The drawing will be conducted at Infinite Energy’s headquarters located at 7001 SW 24th Avenue, Gainesville, FL 32607.

 

7.             ODDS:  The odds of winning are unknown, as they depend on the number of Eligible Accounts.

 

8.             WINNER NOTIFICATION AND ACCEPTANCE:  The winner will be notified via telephone no later July 6, 2011.  The winner may waive his or her right to receive a prize. No prize may be assigned or transferred.  The winner is solely responsible for the reporting and payment of any taxes on a prize.  As a condition of receiving his or her prize, the winner must complete an IRS Form W-9 and an Infinite Energy Publicity Release, which must be signed and returned to Infinite Energy prior to any delivery of the prize.  Failure to sign the requisite forms listed above or to comply with any term or condition of these Official Rules may, at the sole discretion of Infinite Energy, result in the winner's disqualification and the forfeiture of his or her interest in a prize. Acceptance of the prize constitutes the winner's (a) agreement to comply with these Official Rules, and (b) consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from Infinite Energy and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation. 

 

9.             LIMITATIONS OF LIABILITY:  By not opting out of entry into the drawing, pursuant to Section 1, above, each Account Holder agrees (a) any and all disputes, claims, and causes of action arising out of or connected with the Giveaway, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred except in no event shall (i) Account Holder’s attorneys' fees be recoverable and (ii) shall such out-of pocket costs exceed $100; and (c) under no circumstances will any account holder be permitted to obtain any award for, and Account Holder hereby waives all rights to claims for punitive, incidental, indirect, special or consequential damages or any other damages not specifically allowed for herein. 

 

10.          CONSTRUCTION:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestants and Infinite Energy in connection with the contest, shall be governed by, and construed in accordance with the laws of the state where the residential account service is received, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the applicable state.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

11.          GENERAL RELEASE:  By accepting any prize associated with the Free Gas Giveaway, each winner hereby expressly releases Infinite Energy and any directors, officers, employees, representatives and agents thereof from any and all liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Free Gas Giveaway or with the receipt, acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or loss or destruction of property, rights of publicity or privacy, defamation, and portrayal in a false light).

 

12.          MISCELLANEOUS:  The Free Gas Giveaway is sponsored by Infinite Energy, whose decisions regarding the selection of winners and all other aspects of the Giveaway shall be final and binding in all respects and upon all parties.  Infinite Energy reserves the right to cancel or modify the Giveaway in whole or in part at any time in its sole and absolute discretion for any or no reason.  Infinite Energy is not responsible for typographical, printing or other inadvertent errors in these official rules or in other Giveaway materials.
